In today's world, much revolves around the pursuit of more and more optimization - optimization of processes, optimization of consumption, self-optimization. This trend does not stop at arbitration. Arbitration institutions, parties and lawyers around the world are looking for "the" most optimal arbitration proceedings.

But is this really in the interests of users? Should every new innovation be pursued? And what is the source of the desire for constant innovation? These and other questions will be explored at this year's fall conference. Following the motto of "Higher, faster, further? Drivers of innovation in arbitration", the DIS Autumn Conference held on 10 September 2024 in Berlin will shed light on various new trends and so-called innovations in the field of international arbitration and will ask where the urge to invent comes from in each case. International panels with in-house counsel, representatives of international arbitration institutions, speakers from the Ministry of Justice, arbitrators and lawyers will critically discuss all facets of these innovations:

  • In a debate, the panelists will determine whether there is still a need for real party-appointed co-arbitrators, or whether they should be appointed directly by the arbitral institution in the interests of promoting and increasing diversity.
  • Is it really in the interest of the parties that complex international arbitration proceedings should turn out to be ever shorter and conducted with less and less effort? How efficient is possibly too efficient?
  • The ever more complex requirements for the assessment and disclosure of potential conflicts of interest pose increasing difficulties for international arbitrators - and thus for internationally active parties - because global networking makes the necessary review of all potentially relevant facts much more difficult and subsequently renders necessary disclosures more likely. A panel will also discuss the pros and cons of this issue and consider where the user's interest which is to be protected really lies.
  • The same applies with regard to maximum confidentiality in arbitration proceedings, which has always been one of arbitration’s main features. Is this actually still up to date since the demand for transparency and publicity has been growing louder recently? Aren't there technical means nowadays to help achieving both confidentiality and transparency?
  • And, of course, the topic of artificial intelligence and its use in international arbitration proceedings is also being scrutinised and discussed from all sides.

As in previous years, the international "flagship" conference of the DIS forms the centrepiece of the Berlin Dispute Resolution Days, which bring arbitration lawyers and practitioners from many nations to Berlin every year.
