We are pleased to report that the turn of the year at the DIS was accompanied by numerous proceedings not only under the 2018 DIS Arbitration Rules but also under the 2010 DIS Mediation Rules (“DIS Mediation Rules”).
From December 2022 to January 2023, five large-volume mediation proceedings were initiated under the DIS Mediation Rules. These proceedings involve a total of fourteen parties from two continents and five countries and have disputed amounts in the six to seven-digit range. They therefore seem to confirm a new and very welcome trend towards more large-volume, multinational DIS mediation proceedings, which has reached its – hopefully only temporary – peak with the recent submission of a mediation application, in which the parties are arguing over several hundred million euros.
Our recent “turn of the year mediation proceedings” deal with disputes in the areas of construction, energy, distribution and investments. They are each conducted by a single mediator. Co-mediations with at least two mediators remain the exception in the DIS mediation proceedings.
We hope that the trend towards more (DIS) mediation proceedings will continue and in support of this trend, we announce that its promotion will be a project of the DIS in the near future.
