At the latest with the EU Representative Actions Directive mass claims — a phenomenon known especially from the U.S. — seem to have made their way to Europe. Many plaintiffs suing one respondent based on the same or a similar set of facts, this scenario is known also in German ordinary litigation.
But will this concern arbitrations in the (near) future? Is arbitration the right forum to address mass claims? With rules for multi-party arbitrations existing already, is there a sufficient framework for mass arbitrations?
