DIS Energy Group: Arbitration – hurdle or support of the energy transition?

The global transition to a decarbonized energy production in the span of just a few decades arguably represents one of the most ambitious and transformational projects ever attempted. In order to accomplish climate neutrality by 2050 the European Commission estimates that in the EU alone a staggering investment of 396 Billion Euro will be needed each year until 2030 – with another 520-572 Billion Euro yearly in the subsequent two decades. Transmission lines, smart grids, wind farms, solar plants, energy storage facilities, as well as H2 electrolysers and pipelines will have to be designed, built, and commissioned at unprecedented scale, under tight schedules and a global supply chain riddled with uncertainty. To say nothing of the planned construction of new nuclear power plants and the repurposing of old gas-powered ones. All this spells conflict.

To master this challenge, industries and investors can ill afford a dispute resolution mechanism hampered by delays, red tape and calcified procedures.

Can (International) Arbitration in its current form respond adequately to those needs? Or do we need to completely rethink the way we approach conflicts under these circumstances?

What are the decisive factors influencing the choice of a particular dispute resolution scheme in this context? Who are the players, what are the levers, and may we even need a mandatory, centralized mechanism to establish legal certainty?

Anna Masser (Partner, A&O Shearman) and Florian Cahn (General Counsel, Framatome GmbH) will discuss these and other questions with Kai-Uwe Karl, Global Chief Litigation Counsel at GE Renewable Energy, and hopefully elicit some concrete advice and ideas for managing conflicts in the frame of this huge undertaking.
