On Thursday, 7 November 2024, the newly established DIS Regional Group Rhein/Ruhr hosted an enriching event titled “How Digital Should/Must Arbitration Be Today?”. The event offered a valuable opportunity for attendees to gain a comprehensive overview of AI's - often complex - role in the modern legal practice generally, and within arbitral proceedings more specifically.

Diverse Perspectives on AI in Legal Practice

The attendees were presented with a diverse range of perspectives on the topic of the evening. During the panel discussion, moderated by Erik G. Schäfer,

  • Christina Fischer (OpenText) showcased a Technology-Assisted Review (TAR) tool, explaining its functionality and its practical applications in document review,
  • Glenn Baumgarten (Deutsche Telekom) shared practical insights on the daily implementation of AI tools within a corporate legal department, commending their impact on efficiency and workflow, and
  • Lisa Reiser (Baker McKenzie) provided an overview of regulatory standards established by guidelines for AI use in arbitration, such as the Silicon Valley Arbitration & Mediation Center’s “Guidelines on the Use of Artificial Intelligence in Arbitration”, which helps frame the discussion around the responsible use of AI.

Open Discussion: Navigating AI’s Complexities and Challenges

This combination of viewpoints created a balanced impression of both the opportunities AI presents and the complexities it introduces to the legal field, provoking an interesting open discussion between the panellists and attendees on the arising risks to be considered.

Key concerns included the implications of the processing of sensitive data by AI tools, whether AI reliance might hinder the development of what are considered today to be foundational skills for lawyers, the degree of reliability of AI tools as well as the question of the need for transparency concerning AI usage by legal professionals.

The evening, hosted at Clifford Chance’s office in Düsseldorf, concluded with guests mingling in a relaxed setting, fostering connections and sharing their thoughts on the event's topics.
