Organised within the context of the DIS Rules Clinic on Settlement, this event will discuss approaches to settlement in arbitrations in the Middle East and Africa. The starting point is the framework provided by the CRCICA and KIAC Rules and the implementation of these rules in practice. We will examine questions such as the following:
- Can one speak of typical approaches to settlement, or is the dispute resolution culture fragmented in such a way that the approach taken depends on the specific case in question?
- If this is so, what is the role of the arbitral institution?
- What tools to promote settlement should international parties, their counsel, and arbitrators, bear in mind, if anything?
CRCICA was established in Cairo 1979 and today is one of the most prominent Arab arbitration institutions with a reach far beyond the Middle East. KIAC was established in Kigali in 2010, and is a more recent, particularly dynamic player in the African market. Both institutions are active on the international level and committed to enhancing regional cooperation in Africa.
