2023 saw numerous important developments related to the enforcement of investor-state arbitration awards before national courts. These developments are highly relevant to parties engaged in investor-state disputes and to the ongoing debate about the future course of the investor-state dispute settlement system in Europe and around the world.
In a discussion moderated by Richard Happ, our panelists, Carlos Ramos-Mrosovsky (BakerHostetler, New York) and Evgeniya Rubinina (Enyo Law, London) will address issues including
- the reception of the CJEU’s Achmea decision by enforcing courts in the US and UK;
- efforts to collect judgments against sovereigns from the assets of various state-owned enterprises; and
- significant recent decisions related to sovereign immunities and the impact of corruption allegations on the enforceability of international awards.
